U.S. Reg. No.\u00a04834592 protects \u00a0&#8220;a three dimensional trade dress depicting the appearance and design of the interior of a restaurant evoking a Mexican wrestling theme.&#8221;<\/p>\n<p><a href=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2017\/03\/4834592.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-215 aligncenter\" src=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2017\/03\/4834592.jpg\" alt=\"\" width=\"458\" height=\"311\" \/><\/a><\/p>\n<p>However it is doubtful that the the protection afforded by this registration is as broad as the optimistic description. \u00a0The registrant is unlikely to be able to protect this &#8220;theme&#8221; apart from the various features depicted in the drawing.<\/p>\n<p>Similarly, Reg. Nos.\u00a04783688 and 4830189 protects\u00a0the &#8220;three-dimensional trade dress configuration depicting the interior of a retail beverage store evoking the theme of an aviation airfield.&#8221;<\/p>\n<p><a href=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2017\/03\/4830189.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright  wp-image-217\" src=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2017\/03\/4830189.jpg\" alt=\"\" width=\"238\" height=\"174\" \/><\/a><\/p>\n<p><a href=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2017\/03\/4783688.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-216 alignnone\" src=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2017\/03\/4783688.jpg\" alt=\"\" width=\"294\" height=\"145\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>Again, despite the broad reference to theme, the registered marks are not likely to be infringed unless the pictured elements are present.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A few attempts have been made to protect a &#8220;theme&#8221; rather than a specific mark.
