{"id":274,"date":"2017-06-20T20:49:10","date_gmt":"2017-06-21T00:49:10","guid":{"rendered":"https:\/\/trademarks.harnessip.com\/?p=274"},"modified":"2017-06-25T22:13:51","modified_gmt":"2017-06-26T02:13:51","slug":"immorality-scandal-and-disparagement-at-the-trademark-office","status":"publish","type":"post","link":"https:\/\/trademarks.harnessip.com\/?p=274","title":{"rendered":"Immorality, Scandal, and Disparagement at the Trademark Office"},"content":{"rendered":"<p>In <a href=\"https:\/\/www.supremecourt.gov\/opinions\/16pdf\/15-1293_1o13.pdf\">Matal v, Tam<\/a>, the Supreme Court affirmed the Court of Appeals for the Federal Circuit \u00a0in holding that the 15 USC \u00a71052(a)&#8217;s prohibition against the registration of disparaging marks was unconstitutional as a violation of the First Amendment, \u00a015 USC \u00a71052(a) provides:<\/p>\n<p style=\"padding-left: 30px;\">(a) Consists of or comprises immoral, deceptive, or scandalous matter; or matter which may disparage or falsely suggest a connection with persons, living or dead, institutions, beliefs, or national symbols, or bring them into contempt, or disrepute;<\/p>\n<p>While the case before the Supreme Court related to disparaging marks (the same prohibition that caused the Washington Redskins to lose their registrations on REDSKINS), in January in <em>In re Brunetti<\/em>, the U.S. Patent and Trademark Office told the Federal Circuit that:<\/p>\n<p style=\"padding-left: 30px;\">Although a court could draw constitutionally significant distinctions between these two parts of [\u00a71052(a)] \u00a0we do not believe, given the breadth of the court&#8217;s Tam decision and in view of the totality of the court&#8217;s reasoning there, that there is any longer a reasonable basis in this court&#8217;s law for treating them differently.<\/p>\n<p>So, its now open season on immoral, scandalous, and disparaging trademarks. \u00a0It didn&#8217;t take long for applicants to take advantage of the decision, with applications being filed later the same day.<\/p>\n<p><a href=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2017\/06\/shit.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-275 aligncenter\" src=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2017\/06\/shit.jpg\" alt=\"\" width=\"744\" height=\"201\" srcset=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2017\/06\/shit.jpg 744w, https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2017\/06\/shit-300x81.jpg 300w, https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2017\/06\/shit-500x135.jpg 500w\" sizes=\"auto, (max-width: 744px) 100vw, 744px\" \/><\/a><\/p>\n<p>These types of filings actually began shortly after the Federal Circuit&#8217;s\u00a0December 22, 2015, decision,\u00a0and will no doubt increase with the Supreme Court&#8217;s decision.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In Matal v, Tam, the Supreme Court affirmed the Court of Appeals for the Federal Circuit \u00a0in holding that the 15 USC \u00a71052(a)&#8217;s prohibition against the registration of disparaging marks was unconstitutional as a violation of the First Amendment, \u00a015 &hellip;
