{"id":340,"date":"2018-07-18T09:36:50","date_gmt":"2018-07-18T13:36:50","guid":{"rendered":"https:\/\/trademarks.harnessip.com\/?p=340"},"modified":"2018-07-20T10:27:39","modified_gmt":"2018-07-20T14:27:39","slug":"bad-vibes","status":"publish","type":"post","link":"https:\/\/trademarks.harnessip.com\/?p=340","title":{"rendered":"Bad Vibes"},"content":{"rendered":"<p>A mobile marketing company has <a href=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2018\/07\/2018-TRADEMARK-Vibe-Media-v-KKW-Fragrance-VIBES-perfume.pdf\">sued<\/a>\u00a0Kim Kardashian West&#8217;s fragrance company, KKW Fragrance, LLC in Chicago, claiming the celebrity&#8217;s VIBES line of perfume (left, below) infringes the company&#8217;s registered VIBES trademark and logo (right, below).<\/p>\n<p><a href=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2018\/07\/VIBES.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-341\" src=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2018\/07\/VIBES.jpg\" alt=\"\" width=\"606\" height=\"176\" srcset=\"https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2018\/07\/VIBES.jpg 606w, https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2018\/07\/VIBES-300x87.jpg 300w, https:\/\/trademarks.harnessip.com\/wp-content\/uploads\/2018\/07\/VIBES-500x145.jpg 500w\" sizes=\"auto, (max-width: 606px) 100vw, 606px\" \/><\/a><\/p>\n<p>The marks are similar in both literal elements and display.\u00a0 There are 500 registrations on marks including the word &#8220;vibes,&#8221; and 2532 registrations on marks containing thought or speech balloons, but plaintiff&#8217;s is the only one that contains both of these elements.\u00a0 However, one wonders if plaintiff can make the case that consumers or perfume are likely to be confused by a mobile media company, or vice versa.\u00a0 The Complaint references the use of mobile marketing to promote KKW&#8217;s fragrance, but is that enough to cause consumers to believe that the two businesses are in any way related.<\/p>\n<p>If KKW was going to have a problem, one might have thought it would come from an owner of one of the 11 existing registration on VIBES for perfume, rather than a similarly named mobile marketing company.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A mobile marketing company has sued\u00a0Kim Kardashian West&#8217;s fragrance company, KKW Fragrance, LLC in Chicago, claiming the celebrity&#8217;s VIBES line of perfume (left, below) infringes the company&#8217;s registered VIBES trademark and logo (right, below).
